1. A decoder for decoding at least one picture from a multi layered scalable video data stream, the multi layered scalable video data stream comprising a first sequence of pictures in a first layer and a second sequence of pictures in a second layer, wherein each of the first layer and the second layer comprise a plurality of temporal sublayers,
wherein the decoder is configured to decode, based on a signalization derived from the scalable video data stream, one or more of the plurality of temporal sublayers of the second layer using inter-layer prediction, the signalization indicating which temporal sublayers of the second layer are to be decoded using inter-layer prediction,
wherein the signalization comprises a predetermined temporal identifier to indicate which temporal sublayers of the second layer are to be decoded using inter-layer prediction,
wherein the temporal sublayers of the second layer which comprise a temporal identifier having a value above the predetermined temporal identifier are decoded without using inter-layer prediction, and
wherein, if the decoder derives from the signalization that a temporal sublayer of the second layer does not use a temporal sublayer of the first layer for inter-layer prediction, the decoder is configured to discard the temporal sublayer of the first layer and not use the temporal sublayer of the first layer when decoding the temporal sublayer of the second layer.
