1. A plant cell comprising at least one copy of an expression modulating element operably linked to a polynucleotide, the expression modulating element consisting essentially of a nucleic acid sequence having at least 98% sequence identity to SEQ ID NO: 1, and the polynucleotide comprising a promoter, the promoter heterologous to the expression modulating element, and a gene of interest or a functional RNA, wherein expression of the gene of interest or functional RNA is increased as compared to a control plant cell not comprising the expression modulating element.
