1. A method of decoding a picture from a bitstream, wherein the picture comprises one or more slices, and wherein the bitstream comprises a picture header, and an adaptation parameter set, the method comprising:
decoding, from the picture header, a first syntax element which is related to partitioning and is to be used for INTRA corresponding to a coding type of a slice, if:
(a) a value of a partition constraints override flag, in the picture header, relating to partitioning is 1; and
(b) a predetermined syntax element, having a value of 0, in the picture header indicates that all slices in the picture use INTRA;
and
decoding said one or more slices using said decoded first syntax element,
wherein a second syntax element which is related to partitioning and is to be used for INTER, wherein INTER corresponds to a coding type of the slice, is capable of being decoded from the picture header depending on a value of the partition constraints override flag and a value of the predetermined syntax element,
wherein even if the value of the partition constraints override flag is 1, the second syntax element is not decoded from the picture header if the predetermined syntax element, having the value of 0, in the picture header indicates that all slices in the picture use INTRA, and
wherein the adaptation parameter set is capable of being located after the picture header in the bitstream and is capable of including information related to an adaptive loop filter.
